By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement.

If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Description of the Service

PearCRM is a cloud-based customer relationship management (CRM) platform that may include features such as:

• Workspaces
• Dashboard
• Customers
• Documents
• Products
• Orders
• Payments
• Calendar and Tasks
• Team Chat
• Inbox
• Analytics
• Integrations with third-party services including Telegram, Discord, Email, WooCommerce, Stripe, Meta services, TikTok, and other supported providers.

Some features may be unavailable depending on your subscription plan or development stage.

We reserve the right to modify, add, suspend, or remove any feature at any time.

3. Accounts

You are responsible for:

• maintaining the confidentiality of your login credentials;
• all activities performed through your account;
• ensuring that your information remains accurate.

You must immediately notify us if you believe your account has been compromised.

We are not responsible for unauthorized access caused by weak passwords, credential sharing, phishing, malware, or your failure to protect your account.

4. Acceptable Use

You agree not to:

• violate any applicable law;
• upload malicious software;
• attempt unauthorized access;
• interfere with the Service;
• send spam through the Service;
• store illegal content;
• infringe intellectual property rights;
• use the Service to harass or harm others.

We may suspend or terminate accounts that violate these Terms without prior notice.

5. Customer Data

You retain ownership of all data you upload.

You grant PearCRM only the limited rights necessary to host, process, store, transmit, and display your data solely for providing the Service.

You represent that you have all necessary rights and legal bases to process any personal data you upload.

You are solely responsible for the legality, accuracy, and integrity of your Customer Data.

6. Security

PearCRM implements commercially reasonable technical and organizational measures designed to protect Customer Data.

However:

• no online service is completely secure;
• no transmission over the Internet can be guaranteed to be 100% secure;
• we do not warrant that unauthorized access, hacking, cyberattacks, malware, or security incidents will never occur.

Except where prohibited by applicable law or caused by our intentional misconduct or gross negligence, PearCRM shall not be liable for security incidents beyond our reasonable control.

7. Third-Party Services

The Service may integrate with third-party providers.

PearCRM is not responsible for:

• outages;
• API changes;
• policy changes;
• data loss;
• security incidents;
• account suspensions;
• billing decisions;
• actions taken by third-party providers.

Your use of third-party services is governed by their own terms and privacy policies.

8. Subscription Plans

Access to PearCRM requires an active paid subscription.

PearCRM offers multiple subscription plans with different features, usage limits, and pricing.

Subscriptions renew automatically unless cancelled before the start of the next billing period.

If payment cannot be successfully processed, we may suspend or terminate access to the Service until payment is received.

We reserve the right to modify subscription plans, pricing, or included features upon prior notice.

Unless otherwise stated, all fees are exclusive of applicable taxes, including VAT, which remain the responsibility of the Customer.
